2.- CONDITIONS OF ACCESS AND USE OF THE WEB PORTAL
Access to the website is free except for the cost of connection via the telecommunications network supplied by the access provider contracted by the users. Certain services are exclusive to our customers and their access is restricted.
The use of the Portal attributes the status of user of the web portal and implies the acceptance of all of the conditions included in this Legal Notice. The provision of the portal’s service has a duration which is limited to the time the user is connected to the web portal.
The user undertakes to make proper use of the web portal in accordance with the Law and this Legal Notice. The User will be liable to Trust Tech or to third parties, for any damage and harm that may be caused as a result of breaching this obligation.
The use of the Portal for the purpose of damaging property or interests belonging to Trust Tech or third parties, or in any way overloading, damaging or disabling the networks, servers and other equipment (hardware) or computer applications (software) belonging to Trust Tech or third parties is expressly prohibited.
In accordance with current legislation, the user must not reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents available on the website except in cases authorised by law or expressly consented to by Trust Tech or by whoever owns the rights of use, as applicable.
The Internet user who wishes to insert links from their own websites to the portal must meet the conditions detailed below, ignorance of these does not release them from liabilities arising from the Law:
The link will only be linked to the home page of the web portal but may not be reproduced in any way (online links, copy of the texts, graphics, etc.)
In accordance with the applicable legislation in force at any time, establishing frames of any type that surround the web portal or allow the contents to be viewed via internet addresses other than the web portal address is strictly prohibited and, in any case, when they are viewed together with contents outside of the portal in such a way that it: (I) produces or may produce error, confusion or deceive users about the true origin of the service or contents; (II) involves an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of the brand and prestige of Trust Tech.; or (IV) in any way is prohibited by the current legislation.
The web page inserting the link shall not contain any kind of false, inaccurate or incorrect statement about Trust Tech, its partners, employees, customers or the quality of the services it provides.
Under no circumstances will the page bearing the link state that Trust Tech has given its consent to insert the link or that it in any way sponsors, collaborates, verifies or supervises the services of the sender.
The use of any word, figurative or combined mark or any other distinctive sign belonging to Trust Tech within the sender’s page is prohibited, except in cases permitted by the law or expressly authorised by Trust Tech and provided that, in all cases, a direct link is permitted with the web portal in the form established in this clause.
The page establishing the link must faithfully comply with the law and may not under any circumstances have or link their own or third party contents which: (I) are illegal, harmful or contrary to morals and good customs (pornographic, violent, racist, etc.); (II) lead or could lead to the User having a misconception that Trust Tech subscribes to, endorses, adheres to or in any way supports, the ideas, statements or expressions, legal or illegal, of the sender; (III) are inappropriate or not relevant to the activity of Trust Tech in terms of place, contents and theme of the sender’s website.
The access service to the portal includes links that enable the user to access other websites and portals. In these cases, Trust Tech acts as a provider of intermediary services in accordance with article 17 of Law 34/2002, of 12th July, on Information Society Services and Electronic Commerce (LSSI) and will only be liable for the contents and services supplied on the Linked Sites to the extent to which it has actual knowledge of the illegality and has not deactivated the link with due diligence.
The existence of linked websites must not, under any circumstances, imply the existence of agreements with the website managers or owners or identification of Trust Tech with the statements, contents or services provided.
Trust Tech is not aware of the content and services of the Linked Websites and therefore does not accept any liability for the damages caused by the illegality, quality, outdatedness, unavailability, error or uselessness of the content and/or services of the Linked Websites or for any other damage that cannot be directly attributed to Trust Tech.
3.- INTELLECTUAL PROPERTY
Trust Tech is the owner or licensee of all of the intellectual and industrial property rights of its website, as well as the elements contained within it. For this reason, the reproduction, distribution, public communication and transformation of all or part of the contents of this website is expressly prohibited.
The brands, trade names or distinctive signs belong to Trust Tech or third parties, and access to the web portal cannot be understood to attribute any rights over the aforementioned brands, trade names and/or distinctive signs.
All of the products and services on these web pages that do not belong to Trust Tech are brands registered to their respective owners and are recognised as such by our company. They appear on the website of Trust Tech solely for the purpose of promotion and information. These owners may request the modification or removal of the information that belongs to them.
4.- LAW AND APPLICABLE JURISDICTION
This Legal Notice is governed by Spanish legislation. The Courts of Granada will have jurisdiction over any disputes brought before it arising from this contract, unless another jurisdiction applies preferentially due to a legal provision.
In the event of any dispute that may arise in relation to the compliance of this contract, the parties agree that they will try to reach an amicable agreement in good faith before the use of any other means of conflict resolution.
